Call to Order:   The meeting was called to order by Committee Chairman Fanton at 2:14 p.m.

 

Approval of Minutes

A motion was made by Legislator O’Grady, seconded by Legislator Healy and carried approving the minutes of October 5 and October 11, 2011. 

 

Landscaping

Mr. Roeske requested permission to cut down the two remaining trees in the front of the Courthouse.  Mr. Roeske stated these trees are not in good shape and the department would like to replace them with new trees and have a more symmetrical landscaping plan in front of the Courthouse.  A motion was made by Legislator O’Grady seconded by Legislator Healy and carried to approve the removal of the two remaining trees in front of the Courthouse and to proceed with landscaping. 

 

Transfer of Funds

A motion was made by Legislator Ungermann seconded by Legislator Healy and carried to refer to Ways and Means a request for the following funds to purchase an Autoscrub Floor Machine as requested by the Allegany County Sheriff as a clean facility is fundamental to their successful program.

Referral to Ways & Mean Committee

 

Purchase of Used Excavator

Mr. Roeske stated there is approximately $57,000 remaining left in CHIPS funding for this year.  The department would like to purchase a used excavator with the remaining funds.  Mr. Roeske explained the state has threatened to take this funding away and he does not feel comfortable rolling it over to next year.   A motion was made by Legislator Healy seconded by Legislator McGraw and carried to bid a Used Excavator for the Department.    (Opposed:  Legislator Ungermann)

 

Request from Basil Davis

A request presented to the Committee from Basil L Davis of Old State Road, Town of Allen to purchase a piece of County Right-Of-Way that runs through his property.  A motion was made by Legislator Ungermann seconded by Legislator Healy and carried to sell this 1-acre Right-Of-Way to Basil Davis for $400 an acre plus attorney fees. 

 

County Attorney to Prepare Resolution

 

Offer of Property from Blades Real Estate, L.L.C

A motion was made by Committee Chairman Fanton, seconded by Legislator Healy and carried to accept a donation of 13.5 acres (Tax Parcel #105.-1.83) in Belfast from Blades Real Estate, L.L.C.  Mr. Roeske explained there were 4 conditions to Blade’s offer:

 

1.      A clear title/abstract will be provided to the County by Blade Real Estate

2.      No survey map will be provided

3.      No proration of current real estate taxes paid by Blades Real Estate will be required from the County

4.      The transaction must be completed and closed before year end (December 31, 2011)

 

This property is located along County Road 26 and the Genesee River runs through it.  Legislator Ungermann was concerned with removing this property from the tax rolls.  Mr. Roeske explained the County tax portion of this property is under $300 a year.  A motion was made by Chairman Fanton seconded by Legislator Healy and carried to accept 13.5 acres of property from Blades Real Estate, L.L.C.  (Opposed:  Legislator Ungermann, Legislator O’Grady)

 

County Attorney to Prepare Resolution

 

Request from Historical Association

A motion was made by Legislator Healy seconded Legislator McGraw and carried to donate 20 file cabinets and any unclaimed used office furniture being stored on the top floor of the County Office Building that may be useful to the Historical Association.

 

Adjournment 

A motion was made by Legislator Ungermann seconded by Legislator O’Grady and carried to adjourn at 2:40 p.m.
