MISSION STATEMENT
The Allegany County Drug Treatment Court is designed to reduce the
effects of substance abuse by offering judicially supervised treatment and case
management to non-violent offenders.
The goal is to enhance individual accountability that will result in
stronger and safer communities and families.
Drug Court Structure
The Allegany County Drug Court will be a Post-Plea Model,
with Deferred Sentencing and Interim Supervision Probation.
To enter the Allegany County Drug Court, defendants will
waive presentation of their cases to a Grand Jury (if Felony) and plead by
Superior Court Information.
(Misdemeanor offenders will plead to designated offense). Any facts contained in a Special Information
or predicate statement will also be admitted by the Defendant. Defendant will further waive all rights to
speedy trial, 710.30 notices, motions and the right to appeal the conviction
and sentence.
As part of the process to be accepted, defendants will
execute any and all releases and confidentiality waivers necessary for all
treatment providers to furnish reports and information to the Allegany County
Drug Court Team.
To formally enter the Allegany County Drug Court, the
defendant will execute a contract outlining the plea, possible and agreed
sentences for completion and non-completion, and the conditions of behavior for
Drug Court participation.
Defendants entering the Allegany County Drug Court will
agree to be placed on Interim Supervision Probation for the length of their participation
in Drug Court, even if such period exceeds the statutory one year of ISP.
